GENERAL TERMS AND CONDITIONS (GCF)
Effective: from 10 January 2026 until revoked<\/p>

These General Terms and Conditions (hereinafter: GTC) govern the web development, maintenance, marketing, and artificial intelligence services provided by M\u00e1rton Horv\u00e1th \u2013 DigiXRAY Labs Webentwicklung & Webdesign DigiXRAY Labs (hereinafter: Service Provider) through the https:\/\/and digixray-labs.com (hereinafter: Website).<\/p>

ATTENTION: By submitting an order or using the services of the Website (including AI Chatbot), the Customer\/User declares that he\/she has read, understood and agrees to be bound by these GTC.<\/p>

2. THE SUBJECT AND NATURE OF THE CONTRACT (SPECIFIC SERVICE)
2.1 The Service Provider shall undertake the creation, acceleration, marketing copywriting and integration of AI-based solutions of customized websites tailored to the specific needs of the Customer within the framework of a contract.

2.2 The parties stipulate that the product created (website, source code, graphics, text) is not a prefabricated product, but an intellectual creation created on the basis of the Customer's instructions and specifically at his request.<\/p>

3. USE OF DIGITAL TOOLS AND AI TECHNOLOGIES
The Service Provider uses state-of-the-art technologies to improve service delivery and user experience. By using the Website, the User expressly accepts the use of the following tools:<\/p>

3.1 Artificial Intelligence (AI) Chatbot - Aminos.ai<\/p>

AI Act Disclaimer: In accordance with the Regulation of the European Parliament and of the Council on Artificial Intelligence (AI Act), we inform you that in the chat window available on the Website, you are communicating with an artificial intelligence-based software (bot), not a living person.<\/p>

Disclaimer: The answers provided by the AI chatbot (Aminos.ai) are for information purposes only. Due to the nature of the technology, inaccuracies or \u201challucinations\u201d may occur. The Service Provider is not liable for any business decisions or damages based on the answers provided by AI. Only a signed quotation sent by email by the Service Provider shall be considered a formal quotation.<\/p>

Data processing: the content of conversations may be recorded by the system for quality assurance purposes. Please do not share sensitive personal data (e.g. credit card details, passwords) in the chat interface.<\/p>

3.2. Behaviour Analysis and Heat Maps - Microsoft Clarity<\/p>

How it works: the Website uses Microsoft Clarity, which records how you use the site (heat maps, session replays). This helps us to fix bugs and optimise the user experience.<\/p>

Data protection: in accordance with the GDPR, Clarity pseudonymizes the data and automatically masks the content of the input fields, so no personal data is recorded. By using the Website, you acknowledge this technical analysis.<\/p>

4. PAYMENT TERMS (50-50% AND DIGITAL PLEDGE)
4.1 Payment Schedule: project-related assignments are paid in two instalments:<\/p>

Instalment I (Project Start-up Advance): 50% of the total contract fee. The start of work is conditional upon receipt of this amount.<\/p>

Instalment II (Final invoice): the remaining 50% is due upon technical completion of the project, after acceptance of the test version, but before the live version.<\/p>

4.2. Reservation of Ownership and Digital Lien: Until full payment is made, the website, source code and content remain the property of the Service Provider. In the event of non-payment, the Service Provider is entitled to restrict or suspend the operation of the website or to reclaim the digital assets provided (enforcement of digital lien).<\/p>

4.3. Failure Penalty: If the Customer withdraws after the work has started or fails to pay the final invoice within 8 days, the 50% advance payment shall be due to the Service Provider as a failure penalty for the work performed and the capacity reserved.<\/p>

5. EXCLUSION OF THE RIGHT OF WITHDRAWAL
5.1. \u00a7 The Customer shall NOT be entitled to a 14-day right of withdrawal without justification after the commencement of performance.5.2.<\/p>

6. PERFORMANCE, WARRANTY AND LIMITATION OF LIABILITY
6.1 The Service Provider undertakes to prepare the website in accordance with professional standards. 6.2 Third Party Services. 6.3 Content responsibility. The Service Provider shall be exempt from all copyright claims.<\/p>

7. COMPLAINT HANDLING AND DISPUTES
7.1. Complaints: info@digixray-labs.com. Deadline for response: 30 days. 7.2 Jurisdiction: the contract shall be governed by Hungarian law. The parties agree to the exclusive jurisdiction of the Pest Central District Court or the Metropolitan Court of Budapest, depending on the jurisdiction.<\/p>

The data processing is carried out in accordance with the provisions of Regulation (EU) 2016\/679 of the European Parliament and of the Council (GDPR) and Act CXII of 2011 (Infotv.).
